この前、ウイルスを作った男を現行法で逮捕したじゃん。

制作した段階でって、常駐ソフトを作ってて故意ではなくレジストリいじっちゃったり、DLLを消しちゃったりしても捕まるの？

自分のシステムを守るためにウイルスソフトを作って検証したり、スタックオーバーフローでプログラムを実行させたりしたら駄目なの？

えー、どこまでがウイルス？

これもまた、自白でウイルスを作ってましたって言わせたいわけ？

実被害が出てからで良いジャン。
間違ってシステムに損害を与えるソフト作るのなんてパターンは凄くあるよ？

どこぞのセキュリティソフトなんぞ、実行したが最期、二度とPCが立ち上がらなくなるようなセキュリティソフトもありましたが・・・(苦笑)

間違ってシステムに損害を与えるソフトといえば、アンインストールするとHDDが綺麗になるみｚ（げふんげふん）。
やってることはぱーぺきウイルスですが作成意図はないただの酷いバグなだけで、そういうのも処罰されたらプログラムなんて組めませんわな。

この刑法改正案は「犯罪の国際化及び組織化並びに情報処理の高度化に対処するための刑法等の一部を改正する法律案」から共謀罪の部分を除いたものなのですが、それでも通信履歴を保全しろ等ウイルス以外にもかなり問題ありです。
